137.1 Authorized use of hypodermic syringes and needles.
(a) No school or educational institution may lawfully purchase, acquire, have under control, possess or use any hypodermic syringe or needle for instructional or other educational purposes, unless the school authorities in the case of a school district, the appropriate superior officer in the case of the Department of Education, or the governing board in the case of other educational institutions, has filed a certificate of need with the Commissioner of Education and with the State Department of Health, as required by section 811 of the Education Law, subdivision 1, on a form provided or prescribed by the commissioner.
(b) Authorized use of hypodermic syringes and needles by such institutions shall be limited to actual educational demonstrations or other educational purposes designated in the certificate of need. Any other use is unauthorized and is prohibited.
(c) Certificates of need shall designate the individuals responsible for the custody of hypodermic syringes and needles used in the institution and the names of individuals designated as responsible for supervising the use of such hypodermic syringes and needles.
(1) Any administrative officer of the institution filing a certificate of need may be designated as responsible for the custody of hypodermic syringes and needles used in the institution. It shall be the duty of such officer to provide for safeguards and maintenance of records of disposition of all hypodermic syringes and needles acquired or possessed by the institution.
(2) The head of any department, laboratory or division of the institution filing a certificate of need may be designated as the person responsible for supervising the use of hypodermic syringes and needles in such department, laboratory or division. It shall be his responsibility to keep and maintain the records of all hypodermic syringes and needles used under his supervision.
(d) Any change in designated personnel shall be reported within 30 days to the Departments of Education and Health.
