104.4 Waterfowl hunting.
(a) Persons who hunt waterfowl on the area during the first five days of the duck hunting season must be in possession of a daily Bashakill WMA waterfowl hunting permit issued to them by the department.
(b) Persons who hunt waterfowl on the area after the first five days of the duck hunting season, or during any other waterfowl hunting season, must be in possession of a permanent Bashakill WMA waterfowl hunting permit issued to them by the department. A permanent Bashakill WMA waterfowl hunting permit is not valid during the first five days of the duck hunting season.
(c) Applications for Daily Bashakill WMA waterfowl hunting permits shall be submitted in writing and postmarked between (and including) August 1st and September 1st to the Regional Wildlife Manager, Department of Environmental Conservation, 21 South Putt Corners Road, New Paltz, New York 12561. No more than three persons may apply on the same application. Applications must be on a post card or 3 × 5 index card. Applications must include name, address, telephone number, a current hunting license stamp number, which day(s) they are requesting a permit, and a waterfowl identification certificate number. Applicants are required to have successfully completed a certified course in waterfowl identification. Applicants should indicate their preference for hunting in the North Zone (defined as the portion of the Bashakill WMA north of Haven Road) or South Zone (defined as the portion of the Bashakill WMA south of Haven Road.)
(d) The quota of daily permits to be issued for each zone shall be determined by the department each year.
(e) A preseason selection will be held in September, at the Department of Environmental Conservation Region 3 Headquarters in New Paltz, to select waterfowl hunters for the first three days that waterfowl hunting will be allowed during the duck hunting season.
(f) Applications for Permanent Bashakill WMA waterfowl hunting permits shall be submitted in writing to the Regional Wildlife Manager, Department of Environmental Conservation, 21 South Putt Corners Road, New Paltz, NY 12561. Applications must include name, address, telephone number, and a current hunting license stamp number.
(g) Waterfowl hunting on the area will be allowed on Saturday, Sunday, Tuesday and Thursday during the first split of the duck hunting season as defined in section 2.30 of this Title. Hunting will be allowed each day during the second split of the duck hunting season as defined in section 2.30 of this Title.
(h) Waterfowl hunting on the area will be allowed between sunrise and noon during the first split of the duck hunting season and between sunrise and sunset during the second split of the duck hunting season as defined in section 2.30 of this Title.
(i) Waterfowl hunters may enter the area no earlier than two hours before sunrise and must leave the area by one-half hour after noon, during the first split of the duck hunting season.
(j) Waterfowl hunters shall use or possess afield no more than 25 shells per day.
(k) Waterfowl hunters must be equipped with at least one of the following: hip boots, waders, a boat, or a retrieving dog.
(l) No person shall fail to remove all personal equipment from the area, including spent shells, upon completion of each day's hunt.
(m) No person shall, while on the area, erect, occupy or hunt from a permanent blind.
(n) Consistently shooting at waterfowl which are out of the effective killing range of the shotgun being utilized is prohibited.
(o) Bashakill WMA waterfowl hunting permits shall be valid only for the period and location for which they are issued, and shall not be transferable. The department may revoke a Bashakill waterfowl hunting permit at any time.
(p) Waterfowl hunters must show their Bashakill WMA waterfowl hunting permit to anyone requesting to see it.
(q) The department may require permittees to submit reports of their waterfowl hunting activities on forms provided by the department.
(r) The department may refuse to issue a Bashakill WMA waterfowl hunting permit to anyone, revoke a Bashakill WMA waterfowl hunting permit, or eject a person from the area for failure to comply with the provisions of the Environmental Conservation Law, hunting, fishing or trapping regulations established by the department, or the regulations or conditions contained on special use permits.
