190.6 Schedule of charges.
(a) No contractor may charge for towing or emergency road services covered by these regulations in excess of the schedule of charges awarded by the Department of Transportation with the contract. The department shall give notice of the schedule of charges at the time of the solicitation of bids for each contract. The department may adjust the rates on an annual basis, but may not adjust the schedule downward without the consent of contractor during the contract period.
(b) The contractor shall not require that the vehicle be towed to its premises or to any particular premises for repairs, but shall tow the vehicle to any facility designated by the operator of the towed vehicle. If the contractor tows the vehicle to its facility, the contractor shall not make charges for repairs greater than normally charged by such facilities in the region.
(c) At the time the contractor arrives at the location of the vehicle needing service, it shall present the operator its schedule of charges for towing, emergency road services and storage, which shall be the same schedule of charges issued with its contract.
(d) All contractors must honor one major interbank charge card for services rendered under this Part. Contractors may not refuse towing or emergency service for lack of the motorist's immediate ability to pay, and may not require collateral for release of vehicles.
(e) No contractor shall induce or require any operator of a motor vehicle being charged for towing or other services under this Part to execute a waiver of liability for damages to his vehicle caused by the contractor, and no such waiver of liability shall be legally enforced.
