Department records shall be maintained for the retention periods established for each class of records pursuant to the provisions of Arts and Cultural Affairs Law, section 57.05, and Part 188 of this Title. No record shall be knowingly destroyed or transferred from the custody of the department during the pendency of an application for access or for the amendment or correction of such record made pursuant to Public Officers Law, article 6 or 6-A.
