Dear Mr. Sweat:
*1 Attorney General Mike Moore has received your letter of request and has assigned it to me for research and reply. Your letter states:
*1 I am the Corinth Municipal Court Prosecutor, and a question has arisen concerning Section 97-37-1, Mississippi Code of 1972, Annotated, regarding concealed weapons. Subsection 2 of that section states, “It shall not be a violation of this section for any person over the age of 18 years to carry a firearm or deadly weapon concealed in whole or in part within the confines of his own home or place of business, or any real property associated with his home or business or within any motor vehicle.”
*1 In your opinion, does the provision concerning the carrying of a concealed weapon within a motor vehicle only apply when, the motor vehicle is on real property associated with a person's home or business, or does the provision concerning motor vehicles apply at any time?
*1 In response, it is the opinion of this office that the exception to the concealed weapon law with regard to carrying a concealed weapon in a motor vehicle is not limited to real property associated with a person's home or business. A person over the age of eighteen (18) years may carry a concealed weapon within a motor vehicle anywhere within the state without violating the concealed weapon law.
