RULE 12-209. JUDGMENT
(a) Upon Finding of Right to Condemn. If the court decides that the plaintiff is entitled to condemn, the court, upon the return of the inquisition, shall enter judgment for the plaintiff for the property condemned and for each defendant or class of defendants against the plaintiff for the amount of damages and costs awarded to each defendant or class of defendants.
(b) Upon Finding of No Right to Condemn.
(1) After Trial. If the court decides that the plaintiff is not entitled to condemn, the court shall enter judgment against the plaintiff and for each defendant or class of defendants for costs as provided in Code, Real Property Article, § 12-106.
(2) After Appeal. If the final decision on appeal is that the plaintiff is not entitled to condemn, the trial court shall award a reasonable attorney's fee to the defendant and assess the fee against the plaintiff together with the other costs of the action.
