Rule 4. On Call Procedures
A. If an issue arises in a county where, and when, either of the judges is actively holding court, then that judge shall dispose of that matter.
B. If an issue arises in a county either after hours or during business hours and no judge is actively holding court in that county, then the following procedure applies:
1. For Butler, Hancock, and Ohio Counties: Beginning at 8:00 a.m., c.s.t. on Monday, May 1, 2023, the Division 1 Judge shall be on call for all issues involving search warrants, arrest warrants, emergency mental health issues, emergency protective orders, interpersonal protective orders, emergency juvenile proceedings and Casey's Law petitions. This on call status shall remain in effect for seven (7) days and shall end on the following Monday at 8:00 a.m. At that time, the Division 2 Judge shall then be on call for the next seven (7) days. The two judges will then alternate in the same manner going forth. Furthermore, regarding emergency protective orders and interpersonal protective orders, nothing in this Administrative Order is to be construed as to conflict with the rules governing twenty-four-hour accessibility that are set forth in the Local Rules of the 38th Circuit Family Court.
2. For Edmonson County: Beginning at 8:00 a.m., c.s.t. on Monday, May 1, 2023, the Division 1 Judge shall be on call for all issues involving search warrants, arrest warrants, emergency mental health issues, emergency protective orders, interpersonal protective orders, and Casey's Law petitions. This on call status shall remain in effect for seven (7) days and shall end on the following Monday at 8:00 a.m. At that time, the Division 2 Judge shall then be on call for the next seven (7) days. The two judges will then alternate in the same manner going forth.
Furthermore, regarding emergency protective orders and interpersonal protective orders, nothing in these local rules is to be construed as to conflict with the rules governing twenty-four-hour accessibility that are set forth in the Local Rules of the 8th Circuit.
