Rule 5. Paternity proceedings
501. No judgment of paternity will be granted by the District Court on the basis of consent and agreement between the child's biological mother and purported father without deoxyribonucleic acid (DNA) testing. A paternity petition must be accompanied by consent to testing from the purported father, or by a motion to compel testing with a tendered order noticed for hearing not less than ten (10) days after service (per the Court's schedule in Rule 2). To the extent available, such testing may be arranged through, or facilitated by, the Office of the County Attorney where the petition is filed.
502. Visitation and timesharing with a child in paternity proceedings, if sought by one or both parties, shall be consistent with the First District Court Standard Visitation Schedule attached as Appendix B, unless the parties have a formal agreement to an alternative timesharing schedule, if the Court concludes the alternative agreement preserves the best interests of the child(ren).
