§ 85097.2. Administrative Review of Denial or Revocation of a Continuing Education Course.
Currentness
(a) A vendor may seek administrative review of the denial or revocation of course approval as follows:
(1) The vendor must request an administrative review in writing to the Department's Administrator Certification Section Manager within ten (10) days of receipt of the Department's notice denying or revoking course approval.
(2) The administrative review shall be conducted by a higher-level staff person than the person who denied or revoked course approval.
(3) If the reviewer determines that the denial or revocation of course approval was not issued in accordance with applicable statutes and regulations of the Department, or that other circumstances existed, that would have led to a different decision, he/she shall have the authority to affirm, amend or reverse the denial or revocation of course approval.
(4) The reviewer shall send a written response to the vendor within thirty (30) days of the Section's receiving the request per Section 85097.2(a)(1).
(5) The decision of the higher-level staff person shall be final.

1. Renumbering of former section 85091.2 to new section 85097.2, including amendment of subsection (a)(4) filed 2-7-2022 as an emergency; operative 2-7-2022 (Register 2022, No. 6). A Certificate of Compliance must be transmitted to OAL by 8-8-2022 or emergency language will be repealed by operation of law on the following day.
2. Renumbering of former section 85091.2 to new section 85097.2, including amendment of subsection (a)(4), refiled 8-8-2022 as an emergency; operative 8-8-2022 (Register 2022, No. 32). A Certificate of Compliance must be transmitted to OAL by 11-7-2022 or emergency language will be repealed by operation of law on the following day.
3. Renumbering of former section 85091.2 to new section 85097.2, including amendment of subsection (a)(4), refiled 11-7-2022 as an emergency; operative 11-7-2022 (Register 2022, No. 45). A Certificate of Compliance must be transmitted to OAL by 2-6-2023 or emergency language will be repealed by operation of law on the following day.
4. Certificate of Compliance as to 11-7-2022 order transmitted to OAL 2-3-2023 and filed 3-20-2023 (Register 2023, No. 12).
