§ 12114. Renewal License Applications; Required Forms.
(a) An applicant must file a complete application for a renewal license or Commission work permit with the Bureau no later than 120 calendar days prior to the expiration of the current license or Commission work permit. To be considered timely, the complete application for renewal must be received by the Bureau no later than the date due or, if delivered by mail, be postmarked no later than the date due.
(b) If a complete application for a renewal cardroom owner type license is filed less than 110 calendar days prior to the expiration date of the current license, the application of the cardroom business licensee and each cardroom endorsee licensee required pursuant to subsection (d) will be determined to be untimely and delinquent.
(c) For the purposes of this section, a “complete application” must consist of all of the following:
(1) A completed Application for Employee Category License, CGCC-CH2-04 or Application for Owner Category License, CGCC-CH2-05, as referred to in subsection (a) of Section 12112, and any applicable fees required in Section 12090;
(2) Any applicable investigation deposit specified in Title 11, CCR, Section 2037. However, if, after a review of an application for renewal, the Bureau determines that further investigation is needed, the applicant must submit an additional sum of money that, in the judgment of the Chief of the Bureau, will be adequate to pay the anticipated investigation and processing costs, in accordance with Business and Professions Code section 19867.
(3) A two by two inch color passport-style photograph taken no more than 30 calendar days before submission of the application if the application is for a natural person.
(4) One of the following:
(A) If a resident of the State of California, a Request for Live Scan Service, as referred to in subsection (d) of Section 12112, including the ATI Number. The applicant is responsible for any fees necessary for the completion of this form; or,
(B) If not a resident of the State of California, two Applicant Fingerprint Cards, FD-258.
(5) If the application is an Application for Owner Category License, CGCC-CH2-05, and the applicant is a natural person, then a completed copy of the Spousal Information, CGCC-CH2-12.
(d) Each person who is required to be hold a cardroom endorsee license or TPPPS endorsee license must complete and execute a separate application for renewal of that person’s license. All applications for renewal of a cardroom endorsee license or TPPPS endorsee license must be submitted to the Bureau together with the cardroom business license or TPPPS business license application in a single package, as provided in subsections (a) through (c), inclusive.

2. Amendment of subsections (c)(1) and (c)(5) refiled 12-31-2020 as an emergency; operative 1-1-2021 pursuant to Government Code section 11346.1(d). Emergency expiration extended 60 days (Executive Order N-40-20) plus an additional 60 days (Executive Order N-71-20) (Register 2021, No. 1). A Certificate of Compliance must be transmitted to OAL by 8-2-2021 or emergency language will be repealed by operation of law on the following day.
3. Amendment of subsections (c)(1) and (c)(5) refiled 6-14-2021 as an emergency; operative 6-14-2021. Expiration date of emergency extended 60 days (Executive Order N-40-20) plus an additional 60 days (Executive Order N-71-20) (Register 2021, No. 25). A Certificate of Compliance must be transmitted to OAL by 1-11-2022 or emergency language will be repealed by operation of law on the following day.
4. Amendment of subsections (c)(1) and (c)(5) filed 10-7-2021 as an emergency; operative 10-7-2021 (Register 2021, No. 41). A Certificate of Compliance must be transmitted to OAL by 4-5-2022 or emergency language will be repealed by operation of law on the following day.
5. Amendment of subsections (c)(1), (c)(4)(A) and (c)(5) filed 10-18-2021; operative 1-1-2022 (Register 2021, No. 43). Filing deadline specified in Government Code section 11349.3(a) extended 60 calendar days pursuant to Executive Order N-40-20.4.
6. Reinstatement of section as it existed prior to 12-12-2020 emergency amendment by operation of Government Code section 11346.1(f) (Register 2022, No. 2).
7. Amendment of subsections (c)(1) and (c)(5) refiled 4-4-2022 as an emergency; operative 4-4-2022 (Register 2022, No. 14). A Certificate of Compliance must be transmitted to OAL by 7-5-2022 or emergency language will be repealed by operation of law on the following day.
8. Amendment of subsections (c)(1) and (c)(5) refiled 7-5-2022 as an emergency; operative 7-5-2022 (Register 2022, No. 27). A Certificate of Compliance must be transmitted to OAL by 10-3-2022 or emergency language will be repealed by operation of law on the following day.
9. Certificate of Compliance as to 7-5-2022 order, including further amendment of subsections (c)(1), and (c)(5) and amendment of (c)(4)(A), transmitted to OAL 7-21-2022 and filed 9-1-2022; amendments effective 9-1-2022 pursuant to Government Code section 11343.4(b)(3) (Register 2022, No. 35).
10. Amendment of subsection (c)(5) filed 6-22-2023; operative 10-1-2023 (Register 2023, No. 25).
