§ 831.5. Identification of Cattle and Bison Moving within California.
(a) Dairy cattle born in California after January 1, 2017 must be officially identified as provided in section 831.2(a) of this article prior to leaving their birth premises except when moved directly to a facility that is:
(1) Participating in the USDA's Process Verified Program or Quality System Assessment Program, or another 3rd party age and source verification program approved by the Department for that purpose, and is an Approved Tagging Site in accordance with section 831.1 of this article; or
(2) An Approved Tagging Site in accordance with section 831.1 of this article.
(A) Animals entering a facility meeting the requirements of (1) and/or (2) above, upon arrival, shall be officially identified in accordance with section 831.2(a) of this article.
(b) Dairy cattle require official identification when changing ownership except when moved directly to:
(1) A facility participating in the USDA's Process Verified Program or Quality System Assessment Program, or another 3rd party age and source verification program approved by the Department for that purpose, and is an Approved Tagging Site in accordance with section 831.1 of this article.
(2) An Approved Tagging Site in accordance with section 831.1 of this article.
(A) Animals entering a facility meeting the requirements of (1) and/or (2) above, upon arrival, shall be officially identified in accordance with section 831.2(a) of this article.
(3) A recognized slaughtering establishment and each animal bears a USDA approved backtag.
(A) USDA approved backtag numbers must correlate to the owner.
(B) If a determination to hold the cattle or bison for more than three (3) calendar days is made after the animals arrive at the slaughter establishment, the animals must be officially identified in accordance with section 831.2(c)(4)(B) of this article.
(C) Slaughter establishments must be Approved Tagging Sites in accordance with section 831.1 of this article before applying official identification to animals.
(4) No more than one (1) Approved Livestock Marketing Facility, that is an Approved Tagging Site pursuant to section 831.1 of this article, and then moved directly to a recognized slaughtering establishment where they are slaughtered within three (3) days of arrival; and
(A) A USDA approved backtag is applied to the cattle or bison moving from farm of origin at the Approved Livestock Marketing Facility.
(B) If a determination to hold the cattle or bison for more than three (3) days is made after the animals arrive at the slaughter establishment or Approved Livestock Marketing Facility, the animals must be officially identified in accordance with section 831.2(c)(4)(B) of this article.
(c) Non-virgin sexually intact male cattle less than 18 months of age and sexually intact male cattle 18 months of age and over must bear individual official identification prior to change of ownership, except when moving:
(1) Directly to a recognized slaughtering establishment where they are slaughtered within three (3) calendar days of arrival.
(2) On a Bull Slaughter Agreement pursuant to Title 3, California Code of Regulations, section 820.4(c)(1)(E).
(3) To no more than one (1) Approved Livestock Marketing Facility, that is an Approved Tagging Site pursuant to section 831.1 of this article, and then moved directly to a recognized slaughtering establishment where they are slaughtered within three (3) days of arrival; and
(A) A USDA approved backtag is applied to the cattle or bison moving from farm of origin at the Approved Livestock Marketing Facility.
(B) If a determination to hold the cattle or bison for more than three (3) days is made after the animals arrive at the slaughter establishment or Approved Livestock Marketing Facility, the animals must be officially identified in accordance with section 831.2(c)(4)(B) of this article.
(d) Beef breed female cattle moving to recognized slaughtering establishments must be officially identified in accordance with section 831.2(a) of this article, or have a USDA approved backtag.
(1) USDA approved backtag numbers must correlate to the owner.
(2) If a determination to hold the cattle or bison for more than three (3) calendar days is made after the animals arrive at the slaughter establishment, the animals must be officially identified in accordance with section 831.2(c)(4)(B) of this article.
(A) Slaughter establishments must be Approved Tagging Sites in accordance with section 831.1 of this article before applying official identification to animals.
