§ 831.3. Identification of Cattle and Bison Moving into California.
(a) Cattle and bison listed below must be officially identified before entering California using an official identification device or method as provided in section 831.2(a) of this article:
(1) Sexually intact beef breed male cattle and bison 18 months of age or over;
(2) Sexually intact beef breed female cattle and bison six (6) months of age and over;
(3) Female dairy cattle of any age;
(4) Dairy males born after March 11, 2013;
(5) Cattle and bison of any age used for rodeo, recreational, show or exhibition purposes;
(6) Mexico origin cattle regardless of age or sex; and
(7) Cattle requiring disease testing for interstate movement into California pursuant to Title 3, California Code of Regulations, section 753.1(d); section 755.4(c); section 758(b); and section 820.3(a) through (c).
(b) Cattle and bison are exempt from the official identification requirements of this section for movement into California when:
(1) Moved directly from a location in California through another state to a second location in California.
(2) Moved directly to a California approved tagging site and are officially identified before commingling with cattle and bison from other premises or identified by the use of backtags or other methods that will ensure that the identity of the animal is accurately maintained until tagging so that the official eartag can be correlated to the person responsible for shipping the animal to the approved tagging site.
(3) Moved into California with another form of identification, as agreed upon by the Department and the animal health officials in the shipping state.
(4) Moved into California with a Special Entry Permit as specified in section 831(b)(2) of this article.
(5) Moved directly to a recognized slaughtering establishment where they are slaughtered within three (3) calendar days of arrival; and
(A) They are moved interstate with a USDA approved backtag; or
(B) A USDA approved backtag is applied to the cattle or bison moving from farm of origin at the recognized slaughtering establishment.
(C) If a determination to hold the cattle or bison for more than three (3) calendar days is made after the animals arrive at the slaughter establishment, the animals must be officially identified in accordance with section 831.2(c)(4)(B) of this article.
1. Slaughter establishments applying official identification to animals held more than three (3) calendar days must be Approved Tagging Sites in accordance with section 831.1 of this article.
(6) Moved directly to no more than one (1) Approved Livestock Marketing Facility, that is an Approved Tagging Site pursuant to section 831.1 of this article, and then moved directly to a recognized slaughtering establishment where they are slaughtered within three (3) calendar days of arrival; and
(A) A USDA approved backtag is applied to the cattle or bison moving from farm of origin at the Approved Livestock Marketing Facility.
(B) If a determination to hold the cattle or bison for more than three (3) calendar days is made after the animals arrive at the slaughter establishment or Approved Livestock Marketing Facility, the animals must be officially identified in accordance with section 831.2(c)(4)(B) of this article.
(c) Official identification may be required for any type or age of cattle or bison as determined by the State Veterinarian, for disease traceability, when an existing method providing controlled entry will not satisfactorily provide movement and disease traceability data necessary to prevent the threat, introduction or spread of disease to California livestock.
