§ 3080. General Provisions.
(a) Sections 3200 through 3204 apply to the filing of a complaint, in accordance with provisions of 34 Code of Federal Regulations (34 C.F.R.) sections 300.150, 300.151, 300.152 and 300.153, regarding a public agency's alleged violation of federal or state law or regulation relating to the provision of a free appropriate public education.
(b) Section 3082 applies to due process hearing procedures for the resolution of disagreements between a parent and a public agency regarding the proposal, or refusal of a public agency to initiate or change the identification, assessment, or educational placement of the pupil or the provision of a free appropriate public education to the pupil.
