§ 12472. Request for Additional Permanent Tables.
(a) The cardroom business licensee may apply to operate additional tables on a permanent basis by submitting the following to the Bureau:
(1) A completed and signed application form entitled Cardroom Business License: Gaming Tables, CGCC-CH7-07, referenced in paragraph (1) of subsection (a) of Section 12470.
(2) A non-refundable application fee required in Section 12090 plus a Bureau review deposit pursuant to Title 11, Cal Code Regs., Section 2037, made payable to the Bureau of Gambling Control.
(b) The Commission will not grant the application if any of the following are disclosed by the application or the results of the investigation of the applicant by the Bureau:
(1) The requested increase in the number of tables would exceed the number of tables allowed to be operated by the local jurisdiction for either the particular cardroom or the jurisdiction in which the gambling establishment is located.
(2) The requested increase in the number of tables has been denied by the local jurisdiction in which the gambling establishment is located.
(3) The gambling establishment’s cardroom business license is suspended or is subject to conditions precluding the approval of an increase in the number of tables.
(4) The gambling establishment has outstanding fees, deposits, fines, or penalties owing to the Commission or to the Bureau.
(c) A request by an applicant to withdraw the application will result in the application being considered abandoned and unused deposit amounts returned, with no further action to be taken by the Commission or Bureau.
(d) The Bureau will complete its review of the application and submit its findings to the Commission within 25 calendar-days of receipt of the application. Commission staff will then set the request on the Commission agenda within 90 calendar-days of receiving the Bureau's findings and advise the applicant of the agenda date.

History
1. Renumbering and amendment of former section 12359 to new section 12472 filed 12-12-2020; operative 1-1-2021 pursuant to Government Code section 11343.4(b) (Register 2020, No. 51). Filing deadline specified in Government Code section 11349.3(a) extended 60 calendar days pursuant to Executive Order N-40-20.
2. Amendment of subsection (a) filed 3-11-2021 as an emergency; operative 3-11-2021 (Register 2021, No. 11). Emergency filed 3-11-2021 extended 60 calendar days pursuant to Executive Order N-40-20 and an additional 60 calendar days pursuant to Executive Order N-71-20. A Certificate of Compliance must be transmitted to OAL by 1-7-2022 or emergency language will be repealed by operation of law on the following day.
3. Amendment of subsection (a)(2) filed 10-7-2021 as an emergency; operative 10-7-2021 (Register 2021, No. 41). A Certificate of Compliance must be transmitted to OAL by 4-5-2022 or emergency language will be repealed by operation of law on the following day.
4. Reinstatement of section as it existed prior to 3-11-2021 emergency amendment by operation of Government Code section 11346.1(f) (Register 2022, No. 5).
5. Amendment of subsection (a)(2) refiled 4-4-2022 as an emergency; operative 4-4-2022 (Register 2022, No. 14). A Certificate of Compliance must be transmitted to OAL by 7-5-2022 or emergency language will be repealed by operation of law on the following day.
6. Amendment of subsection (a)(2) refiled 7-5-2022 as an emergency; operative 7-5-2022 (Register 2022, No. 27). A Certificate of Compliance must be transmitted to OAL by 10-3-2022 or emergency language will be repealed by operation of law on the following day.
7. Certificate of Compliance as to 7-5-2022 order, including amendment of subsection (a)(1) and further amendment of subsection (a)(2), transmitted to OAL 7-21-2022 and filed 9-1-2022; amendments effective 9-1-2022 pursuant to Government Code section 11343.4(b)(3) (Register 2022, No. 35).
8. Amendment of subsection (d) filed 9-30-2022 as an emergency; operative 9-30-2022 (Register 2022, No. 39). A Certificate of Compliance must be transmitted to OAL by 12-29-2022 or emergency language will be repealed by operation of law on the following day.
9. Amendment of subsection (d) refiled 12-23-2022 as an emergency; operative 12-30-2022 (Register 2022, No. 51). A Certificate of Compliance must be transmitted to OAL by 3-30-2023 or emergency language will be repealed by operation of law on the following day.
10. Certificate of Compliance as to 12-23-2022 order transmitted to OAL 3-6-2023 and filed 4-14-2023 (Register 2023, No. 15).
