Rule 1. Direct Review of Governing Body Decisions by the Court of Appeals
(a) Scope of Rules. These rules shall govern the procedure by which the Court of Appeals shall have direct review of decisions relating to rate making or rate design by the governing body of a public power entity made pursuant to A.R.S. § 30-802 and reviewable under A.R.S. § 30-812. The governing body of the public power entity shall be subsequently referred to herein as “the Governing Body.” To the extent that they are not inconsistent with these rules, or with the provisions of Title 30 of the Arizona Revised Statutes, the Arizona Rules of Civil Appellate Procedure (ARCAP) shall apply to direct appeals from decisions of the Governing Body.
(b) Parties Taking Appeal. An appeal may be taken from a decision of the Governing Body made pursuant to A.R.S. § 30-802 by the attorney general on behalf of the state, or by any party to the proceedings who is dissatisfied with the Governing Body decision, and who has filed a timely notice of direct appeal and otherwise complied with the provisions of A.R.S. § 30-812 and these rules.
