Rule 25. Failure to Pay Filing Fee on Civil Appeal From Justice Court
When an appeal is taken in a civil case from the justice or municipal court to this court and the appellee fails to pay the clerk of the superior court the fee fixed by law within the time set forth in A.R.S. ยง 22-283 and Rule 10(b), Superior Court Rules of Appellate Procedure-Civil, the court upon the application of the appellant or on its own motion, if deemed just and appropriate, may:
(1) Direct entry of default against appellee;
(2) Affirm the decision in the lower court;
(3) Remand to the lower for further proceedings;
(4) Make ancillary orders pursuant to Rule 12(a), Superior Court Rules of Appellate Procedure--Civil, and
(5) Award costs to appellant.
