126.03.7-7. Compliance and Enforcement.
Currentness
(a) One Call shall require from operators such information as it deems necessary to identify significant or repeated instances of operator and/or excavator noncompliance with Ark. Code Ann. § 14-271-101 et seq. and these Rules.
(b) Any operator, excavator, person or entity unlawfully treated with respect to these Rules may complain to the Commission in writing. The provisions of Ark. Code Ann. § 23-3-119 and the Commission's Rules of Practice and Procedure addressing Formal Complaints shall apply to such complaints.
(c) If the Commission finds that a violation of Ark. Code Ann. § 14-271-101 et seq. has occurred, the Commission may refer the violator to the Attorney General for the execution of Ark. Code Ann. § 14-271-104.
