(a) All operators of underground facilities shall become members of One Call. “Operator” means any public utility as defined in Ark. Code Ann. § 23-1-101, which owns or operates an underground facility; all municipally owned or operated water, sewer, gas or electric utilities; and all nonpublic water, sewer, or gas utilities, owned or operated individually or by property owners' associations, improvement districts, or property developers, serving in excess of one hundred customers. Certain operators may not be subject to the provisions of Ark. Code Ann. § 14-271-101 et seq. if an ordinance or formal resolution was adopted in accordance with Ark. Code Ann. § 14-271-105.

(b) One Call is responsible for identifying all operators as defined in Section 5(a) of these Rules. One Call shall provide written notice of membership requirements to any operator which is not a member.

(c) One Call will report to the Commission the names of all operators which fail to comply with Section 5(a).

(d) Other persons who own or control underground facilities or similar facilities may upon application become members of One Call. Membership shall be evidenced by participation in and payment for the services furnished by One Call.
