016.06.6-800. PERSONNEL
ADHC Providers shall comply with the following staffing and personnel requirements.
801 GENERAL REQUIREMENTS
Staff positions shall be planned and filled according to the goals of the program, the manpower needed to develop and direct the activities which meet these goals, and individual qualifications for the position.
801.1 There shall be a written job description for each position, full-timer, part-time or volunteer. The job description shall specify:
801.1.1 Qualification of education, experience, and personal traits (including such characteristics as ability to relate to people, patience, positive mental attitude, ability to listen, etc.);
801.1.2 To whom the employee is responsible;
801.1.3 Duties and responsibilities.
801.2 References, including former employer(s), shall be required in recruitment of staff.
801.3 There shall be an established procedure to review the qualifications of each employee
801.3.1 at least annually
801.3.2 following any probationary period.
801.4 There shall be a program of orientation of new employees and volunteers.
801.5 There shall be a program of ongoing staff development and in-service training.
801.6 Each employee must provide a written statement from a physician or a physician's assistant certifying good health, including medical evidence of no communicable disease
801.6.1 prior to beginning work
89.1.6.2 annually thereafter.
802 STAFFING
The staffing pattern shall be dependent upon the enrollment criteria and the particular needs of the participants who are to be served. The ratio of paid staff to participants shall be adequate to meet the goals and objectives of the program. The minimum ratios shall be as follows:
802.1. One paid full-time equivalent staff position with responsibility for direct care for each five participants; or,
802.2 When there are four or more participants with a diagnosis of Alzheimer's disease, there must be a minimum of one paid full-time equivalent staff position with responsibility for direct care for each four participants.
803. Substitutes
Whenever paid staff are absent, substitutes must be used to maintain the staff-participant ratio and to assure proper supervision and delivery of health care services.
803.1 In the absence of a regular staff person a substitute staff person may be used in order to maintain the required staff-participant ratio.
803.1.1 Such substitute staff shall have the same qualifications, training, and personal credentials as the regular staff position they are substituting for;
803.1.2 Trained volunteers, with the same qualifications, training and personal credentials as the regular staff position they are volunteering for, may be used instead of paid substitutes.
804 PROGRAM DIRECTOR
The Program Director shall have the authority and responsibility for the management of activities and direction of staff and shall insure that activities and services are appropriate and in accordance with established policies.
804.1 ADHC facilities licensed for more than ten (10) participants must have a full-time Director.
804.2 Facilities licensed for ten (10) or fewer participants may have a full-time Program Director who also serves as the Health Care Coordinator, provided that this individual meets all of the qualification of both positions, and the requirements for the staffing pattern are met.
804.3 The Program Director shall meet all of the minimum qualifications:
804.3.1 Shall be at least 21 years of age;
804.3.2 Shall have completed at least two years of formal post secondary education from a nationally accredited institution of education (college, university, technical institute, or accredited correspondence school);
804.3.3 Shall have at least one year of work experience in an area of human services (e.g., services to the elderly, disabled, or handicapped adults.);
804.3.4 shall have demonstrated ability in supervision and administration;
803.3.5 shall have a current health card.
804.4 To be qualified as a Program Director in an Adult Day Health Care Program, the health care professional must have knowledge of the aspects of aging and appropriate activity programing. The Office of Long Term Care will designate a course curriculum professionals must meet to become qualified. The course curriculum will contain an overview of chronic disabilities of aging populations, psychosocial aspects of aging, the needs of the elderly and activity programing suitable for an adult day care setting. The approval process will contain a provision to deem eligible professionals who can demonstrate prior education or training in these areas.
805 HEALTH CARE COORDINATOR
The program must have a full-time Health Care Coordinator to supervise the delivery of health care services.
805.1 Responsibilities include but are not limited to:
805.1.1 Periodic screening of vital signs, weight, dental health, general nutrition and hygiene of participants;
805.1.2 Monitoring medical regimen;
805.1.3 Monitoring provision of personal care;
805.1.4 Coordinating with other health care professionals and family members concerning health matters;
805.1.5 Educating other staff members about emergency procedures and educating staff and family members about health concerns and conditions of participants;
805.1.6 Providing minor first aid treatment as needed.
805.2 Minimum qualifications:
805.2.1 At least 21 years of age;
805.2.2 A current Arkansas license to practice as a Registered Nurse; or
805.2.3 A Licensed Practical Nurse working under supervision of a Registered Nurse. A statement from the supervising RN must be on file as well as a copy of the RN's current license.
805.2.4 Have a current health card.
805.3 Prior experience shall include at least:
805.3.1 Managerial and administrative skills, including the ability to supervise staff and to plan and coordinate meaningful staff training; and
805.3.2 Knowledge and understanding of the physical and emotional aspects of aging, its associated diseases and infirmities, and related medication and rehabilitative measures.
805.4 To be qualified as a Health Care Coordinator in an Adult Day Health Care Program, the health care professional must have knowledge of the aspects of aging and appropriate activity programing. 806 PERSONAL CARE STAFF
The ADHC shall have sufficient other staff responsible for personal care to comply with these regulations and the care requirements of the participants.
806.1 Minimum requirements are:
806.1 Be at least 18 years of age;
806.2 Have the ability to work with people;
806.3 Have a current health card;
806.4 Have successfully completed a training course for nurse's aides or home health aides.
806.5 Inservice training sessions are required every six months for all Direct Care Staff. Inservice sessions shall total a minimum of four (4) hours per session.
807. VOLUNTEERS
The ADHC shall comply with the following in regard to utilization of volunteers:
807.1 Volunteers shall:
807.1.1 Be at least 18 years of age;
807.1.2 Have the ability to work with people;
807.1.3 Have a current health card.
807.2 Volunteers shall be provided written job descriptions. These shall describe in detail:
807.2.1 task(s) to be performed;
807.2.2 qualifications for performing assigned task;
807.2.3 paid staff position who is responsible for supervising the volunteer;
807.2.4 specifics regarding:
• hours
• days
• and length of commitment of volunteer's services.
807.3 Volunteer shall receive a formal orientation.
807.4 Inservice training sessions are required every six months for all Volunteers. Inservice sessions shall total a minimum of four (4) hours per session.
807.5 Paid staff shall be properly informed of their responsibilities to the volunteer prior to the volunteer's working in the program.
807.6 The volunteer's job performance shall be evaluated annually.
807.7. Provision shall be made for recognition and appreciation of the volunteer, at least on an annual basis.
807.8. Trained volunteers may be counted in the direct care staff-participant ratio. When counted in direct care staff-participant ration, the volunteer shall have the same qualifications as the ADHC staff position being substituted for. (e.g. see item 804.3, 805.2, and 806.1).
808 DUTY RESTRICTIONS
No staff member or volunteer providing direct nursing or personal care shall be permitted to combine housekeeping or kitchen duties with nursing/personal care due to the danger of cross infection to the participants.
809 Non-Direct Care Staff
809.1 The facility shall hire sufficient secretaries, accountants, cooks, housekeepers, or other non-direct care staff needed to operate the program.
809.2 Non-Direct Care Staff shall have a current health card.
810 OTHER HEALTH CARE PROFESSIONALS
Physical therapist, occupational therapist or other health care professionals shall be employed on a contract basis to fulfill the needs and care plans of the participants.
811 INSERVICE TRAINING
Inservice training shall be provided to all ADHC Staff.
811.1 Inservice training sessions for direct care staff are required at a minimum of every six (6) months. Inservice training sessions must total a minimum of four (4) hour per training.
811.1.1 Inservice training subjects shall be appropriate to direct-care staff job functions, and shall include, but are not limited to, sessions on communication with the elderly, normal signs of aging, health problems of the elderly, handling emergency situations, assisting ADL/IADLs, record keeping, and correct procedures for lifting.
811.2 Inservice training sessions for non-direct care staff are required at a minimum of every six (6) months, for a total of four (4) hours.
811.3.1 Inservice training subjects shall be appropriate to non-direct care staff job functions.
