016.06.6-200. LICENSE REQUIREMENTS
Any person who establishes, maintains or operates an ADHC Program which conforms to the requirements set forth in these regulations shall be granted a license from the Office of Long Term Care.
201 LICENSE DISPLAYED
The ADHC shall prominently display its current license in a general use area of the facility.
202 LICENSE APPLICATION
An application shall be submitted to the Office of Long Term Care on forms supplied by the Office for each proposed ADHC Program.
203 LICENSE FEE
A fee of $10.00 shall accompany each application for an ADHC license.
204 LICENSE APPROVAL
The Department shall review each application and investigate each applicant and proposed ADHC Program to determine that they comply with the ADHC licensing law and these regulations and to insure that the health and safety of the participants are protected. Licensure reviews shall be conducted as often as necessary and at least annually.
205 LICENSE ISSUANCE
If the applicant and the ADHC Program are determined to meet ADHC requirements, a license will be issued for a period not to exceed one year. All ADHC Program licenses shall expire on December 31 each year. Renewal applications will be sent to providers at least sixty (60) days prior to expiration. Renewal applications must be accompanied by a $10.00 fee and be post-marked no later than January 30 of the renewal year.. Renewal applications received after January 30 of each year will be charged $1.00 per day penalty until the application is received. Any license not renewed by March 1 of the renewal year shall be revoked.
206 REVOCATION OF LICENSE
A license may be revoked or suspended for failure to cooperate with the Department or failure to comply with statutory or regulatory requirements.
207 APPEAL PROCEDURES
If any person is refused a license, or a license is suspended or revoked, or other official action by the Department is detrimental to the provider of an ADHC Program, a hearing by the Long Term Care Facility Advisory Board may be requested. The request for hearing must be made within thirty (30) calendar days of official notification of the adverse action by the Department.
208 TRANSFER OF LICENSE
The license issued to the ADHC provider shall not be transferable when there is a change of ownership or when the program is moved to another location or facility.
209 AUTHORIZED SIGNATURE
The application for an ADHC license shall be signed by the owner, chairman of the board or chief executive officer and shall be notarized.
