006.24.1-155.0.0. SMOKING POLICY (ACT 462 OF 1987)
Section 155.1.0
Act 462 of 1987 requires that the Chief Administrative Officer of each authority of the State promulgate a smoking policy for the general office space of said agency. The policy shall take into consideration the rights of nonsmokers and smokers.
Smoking refers to any lit tobacco product, such as cigar, cigarette, pipe, etc.
Smoking areas should be designated which are convenient and do not negatively impact upon work productivity.
The following guidelines are provided to assist you in the development of such a policy:
Smoking shall not be allowed or permitted in the following areas:
• Work stations in open areas, separated only by partitions
• Areas where sensitive or flammable material or equipment is housed or stored
• Common areas, such as hallways, restrooms, elevators, medical facilities, hospitals, clinics, libraries, auditoriums and classrooms
Smoking may be permitted in the following areas:
• Break rooms, coffee shops, cafeterias (if large enough, a separate smoking area should be designated)
• Private offices if there is adequate ventilation and the employee provides his or her own air filter system
• Conference rooms may be designated as smoking areas, except when in use for meetings
• If the agency has more than one floor, restrooms on alternating floors may be designated as smoking areas
• If additional areas are needed, the agency's lobby may be designated as a smoking area
