007.10.30-II. Milk Quality Requirements and Enforcement Procedures
A. Basis for Classification
Raw milk for manufacturing purposes, from all individual producers, shall be based on the following: Organoleptic examination (sight and odor), quality control tests for abnormal milk requirements, sediment content, and bacterial estimate. In addition, milk from cows treated with antibiotics shall be excluded for such period of time as is necessary to have the milk free from antibiotics. All milk received from producers shall not exceed Federal Food and Drug Administration established limits for pesticides residues. Producers shall be promptly notified of any shipment or portion thereof of their milk that fails to meet any of the quality spcifications.
B. Organoleptic Examination
Samples of all raw milk delivered at the plant shall be idenitified as to the producer, seller or shipper from whom received. Each can or farm tank of milk shall be examined for physical characteristic, off flavors or off odors, including those associated with developed acidity. The raw milk shall be wholesome and characteristic of normal milk. The flavor and/or off odor of the raw milk shall be fresh and sweet and practically free from off flavors or off odors. However, feed flavors which do not adversley affect the finished product may be present. Any raw milk that shows an abnormal condition (including but not being limited to curdled, ropy, clotted or bloody) or which contains extraneous matter or which shows significant bacterial deterioration shall be rejected to the producer, seller or shipper.
C. Implementation of Abnormal Milk Program
1. A laboratory examination for the presence of somatic cells shall be made on all patron's milk at least 4 times in each 6-month period at irregular intervals.
2. A confirmatory test for somatic cells shall be done when a nerd milk sample exceeds any of the following screening test results:
(a) California Mastitis Test - weak positive (CMT 1+).
(b) Wisconsin Mastitis Test - WMT value of 19 mm.
3. The confirmatory test for somatic cells shall be performed by using one of the following procedures:
(a) Direct Miscroscopic Somatic Cell Count (Single Strip Procedure).
(b) Electronic Somatic Cell Count.
(c) Optical Somatic Cell Count. The results of the confirmatory test for somatic cells shall be the official result.
4. Whenever the confirmatory somatic cell count indicates the presence of more than 1,000,000 somatic cells per ml., the following procedure shall be applied:
(a) The producer shall be notified with a warning of the excessive somatic cell count.
(b) Whenever two of the last four consecutive somatic cell counts exceed 1,000,000 per ml., the state regulatory agency shall be notified and a written notice given to the producer. This notice shall be in effect as long as two of the last four consecutive samples exceed 1,000,000 per ml.
5. An additional milk sample shall be taken after a lapse of three days and within 21 days of the notice required in paragraph 4 (b) of this section. If this sample also indicates a high somatic cell count, the producer's milk shall be rejected until satisfactory compliance is obtained. A temporary status may be approved by the regulatory agency whenever an additional sample of herd milk is tested and found satisfactory. The producer may be fully reinstated when three out of four consecutive tests have counts of 1,000,000 or less somatic cells per ml. The samples shall be taken at a rate of not more than two per week on separate days within a three week period.
D. Sediment Content Classification
1. Milk in cans and in farm bulk tanks shall be classified for sediment contents according to TABLE #1 or #2. Sediment tests shall be conducted as described in the latest edition of APHA Standard Methods for the Examination of Dairy Products.

2. At least once each month, at irregular intervals, one can of milk form each producer shall be selected at random and tested for sediment content by the “off the bottom” method of sediment testing. Milk is in compliance which yields a sediment disc equivalent to standard disc #1, #2 or #3.
For milk in farm bulk tanks, sampling shall be at least once each month, at irregular intervals, a mixed 1 pint sample of milk shall be taken from each farm bulk tank for sediment testing in accordance with the procedure described in “Standard Methods for the Examination of Dairy Products” which will give results comparable to the off-the-bottom method of sediment testing for can milk. If the sediment is classified #1 or #2, the milk is in compliance. Milk classified #3 shall be considered probational milk. This milk may be accepted by the plant. The plant shall promptly notify the producer in writing that his milk sediment graded #3 was accepted under probational conditions. When milk of any producer grades #3, the plant operator shall conduct sediment tests on the producer's future deliveries until the milk grades #1 or #2.
This procedure of testing milk on future deliveries and accepting probational milk may be continued for a time period not to exceed ten calendar days. If, at the end of this time period the producer's milk does not meet the #1 or #2 grade requirements, the producer shall be excluded from the market.
When sediment disc grades #4 (reject milk), it may be accepted if previously co-mingled with other milk. A written notice shall be sent to the producer advising him his milk graded #4. If the plant personnel is unable to get to the farm and take and test another sample before a 2nd delivery of milk, it also may be accepted. No milk shall be accepted from this producer, or co-mingled with other producer's milk, if the milk does not grade #2 or better at the farm. Milk shall grade #1 or #2 within 7 calendar days from the last #4 test, or such producer's milk shall be excluded from the market.
Optional sediment test
Following approval, the United States sediment standards for milk and milk products: using 0.10 inch, 0.14 inch and 0.20 inch diameter filtering area (fine sediment) may be used for classificatin of milk in farm bulk tanks. This permits the smaller “universal” samples of 1, 2 or 4 ounces to be used, and may replaced the standard 1 pint sample for sediment test.

E. Bacterial-Estimate Classification
1. At least once every month at irregular intervals, a bacterial estimate shall be made on a mixed sample of each producer's milk by methods described in the latest edition of Standard Methods for the Examination of Dairy Products.
2. Milk shall be classified for bacterial estimate by one of the following methods:

3. If the sample of milk is classified as #1 or #2, the producer's milk may be accepted. If the sample is classified as “Undergrade” the producer's milk may be accepted for a temporary period of 4 weeks. The producer of “Undergrade” milk shall be notified immediately. Additional samples shall be tested and classified at least weekly and the producer notified of the results. This procedure of testing at least weekly and accepting “Undergrade” milk may be continued for a period not exceeding 4 weeks. During this 4 week period and before exclusion from the market, the producer's last sample shall be tested by the regulatory authority for confirmation and exclusion purposes. Before the producer's supply can be re-accepted, he shall request an additional sample be taken and this sample must be classifed #1 or #2 or he cannot be re-accepted.
F. Adulteration
1. Test for antibiotics
At least four times in most recent six (6) months the mixed milk from each producer shall be tested for antibiotics by a method prescribed in the current edition of APHA Standard Methods for the Examination of Dairy Products, or other tests accepted by the Department. No residue of antibiotics shall be tolerated and when milk from any producer is found to contain such residues, he shall become an excluded producer. Milk from such a producer may be re-accepted when the milk from the herd or from individual cows is found to be free from antibiotics.
2. Test for Extraneous Water
At least four times every six (6) months, the mixed milk from each producer shall be tested for the presence of extraneous water, using the Cryoscopic Test, according to the current edition of APHA Standard Methods for the Examination of Dairy Products or other tests accepted by the Department, evidence of adulteration by water shall constitute cause for exclusion of the producer. The producer's milk supply shall contain a minimum of 8.25% solids not fat when offered for sale.
3. Visible Extraneous Matter
The presence of visible extraneous matter, insects, filth, blood, foreign color, foreign objects or substance in a container shall be considered adulteration and the milk in such container shall be immediately rejected.
G. Records
Accurate records, listing the results of quality tests of each producer, shall be kept on file at the receiving plant where performed and shall be available for examination by the inspector of the regulatory agency.
H. Rejected Milk
A plant shall reject specific milk from a producer if it fails to meet the requirements for appearance and odor or if it is classified #4 for sediment content as described in SECTION II. D. “Sediment Content Classification” or does not meet abnormal milk requirements of SECTION II. C., or is adulterated.
I. Excluded Milk
A plant shall not accept milk from a producer for use in products:
1. If a new producer's milk does not meet the requirements for appearance and odor or sediment content, SECTION II. B.
2. If the milk has been determined to be in violation of the sediment content classification as determined in SECTION II.D.2.
3. If the milk has been determined to be in violation of the bacterial estimate classification as determined in SECTION II.E.3.
4. If milk has been determined as having violated abnormal milk requirements in SECTION II. C. regarding high somatic cell count or having positive test for antibiotics or is above tolerance for pesticide, radionuclides or other adulterants.
J. New Producers
An examination shall be made on the first shipment of milk from producers shipping milk to a plant for the first time or after a period of non-shipment. The milk shall meet the requirements for “acceptable milk”. Thereafter, the milk shall be tested according to the procedures established for regular producers.
K. Transfer Producers
1. When a producer discontinues milk delivery at one plant and begins delivery to a different plant for any reason, the new buyer shall not accept the first delivery until he has requested from the previous buyer and received a copy of the record of the producer's milk quality covering the preceding sixty (60) days and a statement of the farm certification status and date of certification The previous buyer shall furnish the new buyer with some information within two working days after receipt of a written request, unless the records have been destroyed by means over which he has no control. Provided, That the new buyer may accept a producer's milk after making the request for the record by telephone and obtaining assurance from the previous buyer that the producer's milk is acceptable, the new buyer shall then make a written request to the old buyer for the producer's record.
2. If the new buyer requests and fails to receive the quality record from the previous buyer, he shall report such fact to the regulatory agency who shall cause a farm inspection to be made promptly to confirm or establish certification of the transfer producers farm and obtain quality records to verify the acceptability of the producer's milk.
3. In lieu of the quality record from the previous buyer, the produce may furnish the new buyer with a copy of the milk quality tests received with each remittance for the preceding sixty (60) days.
4. The new buyer shall examine and classify each transfer producer's first shipment of milk and shall subsequently examine shipments according to the requirements for regular producers.
5. The status of any Grade A producer whose permit has been suspended shall be cleared by the manufacturing milk company with the regulatory agency before the milk can be accepted. If this milk is received for a period in excess of ten (10) days, such producer shall be subject to all provisions of these regulations.
6. Grade A surplus milk shall be tested or screened by the manufacturing milk company upon arrival to assure themselves and the regulatory agency that the milk is in compliance with these regulations.
